What Should I Do If I Am Falsely Accused Of Domestic Violence?

On Behalf of The Foley Law Firm | August 21, 2021

No matter when you are, domestic violence is a serious charge. That being said, it is not unusual for a person to be falsely accused by a vengeful significant other.

There is no doubt that a false domestic violence accusation can be stressful. If you find yourself in this predicament, it is important that you take the right steps to prove your innocence and avoid conviction.

Here are two things you should keep in mind:

Avoid saying (or doing) anything that can hurt your case

The importance of being on your best behavior in the days and weeks following your false accusation cannot be overstated.

Do not violate any existing restraining orders, lash out at your accuser on social media or contact your accuser to try to negotiate peace. You should also avoid discussing your case with law enforcement, especially in the absence of your legal representative.

Keep your emotions under control

No matter how frustrated you may be, avoid any acts of violence such as punching walls or throwing things around. If you’re spotted, those actions could feed into the narrative that you’re prone to violence.

Keeping a level head during this period can lead to a better outcome for your case. Be sure to eat well, sleep well, and remain focused so you can stay alert and healthy during the trial process. This is not the time to seek refuge in alcohol or drugs.

Domestic violence is a serious offense. If you are falsely accused of domestic violence, take immediate steps to protect your legal interests and your good name.
