What are “Deadly Weapons” in Colorado?

On Behalf of The Foley Law Firm | August 16, 2022

If you meet certain requirements, then it is lawful to possess a gun in Colorado. For instance, you must be at least 18 years old, pass a background check and be a resident of the state.

However, guns are still classed as deadly weapons and if you are holding one unlawfully, you could face severe penalties. Under Colorado law, firearms are not the only type of item that can be classified as a deadly weapon.

Knives and other blades

Knives have conventional purposes, but they can also be used to inflict harm on a person. It’s not out of the ordinary for a fisherman or chef to have knives on them, but if a person carries these items for no other reason than inflicting harm, then they could face weapons charges.

Unusual items

Collectors may gather ceremonial swords, crossbows and other unusual items. Construction workers may even have access to explosive devices. However, these objects can also qualify as deadly weapons in circumstances in which their use is aimed at harming individuals or property. For instance, if an individual has stored explosives and law enforcement finds credible evidence that they intend to use them in a robbery, it’s likely that they will be categorized as a deadly weapon.

Ordinary household items

For a keen baseball player, carrying a bat is a fairly normal occurrence. However, even a popular item like this can cause deadly harm when it is carried with the intent to cause injury. This also applies to metal pipes, tools, broken bottles and bricks.

Context is everything in cases that involve weapons charges. If you believe that you have been wrongly charged with a weapons offense, then it’s important to seek legal guidance so that the matter can be cleared up before the courts.
